Judge Sarah Netburn, one of the presiding officers of Ripple’s lawsuit against the SEC, ordered the Securities and Exchange Commission to file 10 additional documents regarding the SEC’s motion. on the privileges of the lawyer and the client in relation to the documents to william Hinman’s speech.
The SEC is required to submit 10 documents for closed review by June 16, 2022, the court said in a ruling.
The SEC’s recent statement contradicts the previous one.
According to a recent court order, before the Securities and Exchange Commission began to assert the privilege of a lawyer-client with respect to the Hinman document, the SEC was ordered to submit 10 samples of documents for verification in the chamber.
This was due to the agency’s request for a partial review of the court order of January 13, 2022. However, after filing a new motion to protect Hinman’s documents on the basis of attorney and client confidentiality, the Securities and Exchange Commission demanded that the documents be withheld, as well as other documents filed in a Feb. 17, 2022, motion for a partial review.
Judge Netburn noted that the Court had considered the previous 10 documents in the context of the Privilege of Deliberative Process (DPP) and had not done the same to others.
“To facilitate the court’s consideration of communications that, according to the SEC, are subject to attorney-client privilege, by June 26, 2022, the SEC may submit 10 additional documents listed in Appendix 1 for cameral consideration,” the excerpt from the court’s motion says.
